Pro Watercross promotes good conduct by all participants including riders, their friends and family, track officials, volunteers and spectators. Appropriate conduct will provide riders with a safe athletic environment, positive role models, and a sense of community spirit throughout the facility. Pro Watercross participants are to maintain and promote the highest standards of conduct at all times.

PRIZE MONEY AND OTHER AWARDS POLICY

Athletes/participants are eligible to receive prize money in pre-selected classes.
It is up to the athlete/participant to make sure their contact information (mailing address, email address and phone number) is up to date with Pro Watercross.
To receive a checks for your winnings, participants must have a verified IRS Form W-9 (or W-8BEN for Canadian entrants) on file annually. It's important to note that all athletes/participants are engaging in the event as independent individuals and have no affiliation with the event promoter. As independent contractors, athletes/participants are responsible for reporting and paying any applicable income and withholding taxes on the prize money they receive. By collecting the Form W-9, Pro Watercross ensures that they have the necessary information to fulfill their tax reporting obligations.
Once the official race results have been thoroughly reviewed, the prize money will be sent to the winners via USPS mail. Please allow up to four to six weeks for delivery.
Please be aware that prize money/stipends payments will be reported to the IRS as reportable income and is subject to federal, state, and local income tax. If the amount of reportable income including all stipends, prize money, etc. is $600 or more cumulative during a tax year, Pro Watercross will issue a 1099 MISC. Pro Watercross is not offering tax advice, but recipients of Pro Watercross stipends, prize money and benefits are advised to retain their own tax professionals to receive guidance regarding tax implications.
REFUND POLICY
REFUND POLICY
Refunds will NOT be made once practice at any Pro Watercross event has begun; make sure your equipment is running properly prior to the athlete's/riders meeting.
There will be a $10.00 organizational fee for each entry that is refunded. If for some reason you are unable to race once practice has begun, you may be able to transfer your entry to another face with a $10.00 organizational fee, this will be determined on a case by case circumstance.
Refunds issued by check will be charged a $10.00 convenience fee per request submitted.
Refunds issued by credit card will be charged a 5% convenience fee per request submitted.
DRUGS AND ALCOHOL POLICY
For the purposes of this code, “Illegal Substances” include any substance which may not be legally prescribed, either by Federal or State statute, which when taken or ingested may or may-not have a performance enhancing or mood or state of mind altering effect. For the purposes of this code, “Controlled Substances” include any substance which may be legally prescribed, either by Federal or State Statute, which when ingested or taken may have a performance enhancing or mood or state of mind altering effect.
It is forbidden for any participant or Pro Watercross Member to illegally use, possess, acquire or distribute any Controlled or Illegal Substance, at any time. Conviction or a finding of guilt in any criminal proceeding involving the illegal use of Illegal Substances or Controlled Substances may subject the participant / Pro Watercross Member to sanctions under this Code. Nothing contained herein shall be construed as to discourage the proper use of medically necessary prescribed or over the counter medications.
It is forbidden for any participant or Pro Watercross member to illegally posses, acquire or distribute any prescription or over-the-counter medication. Further, it is forbidden to misuse any prescription or over-the-counter medication in a manner not consistent with the prescription or instructions provided by the manufacturer and/or prescriber or pharmacist.
It is forbidden for any participant to consume any alcoholic beverage in a manner which may affect his/her behavior during practice, qualifying or the racing portions of an Pro Watercross Event. Pro Watercross’ standard for being “under the influence” is that any person who is deemed to be acting abnormally or is impaired, at the sole discretion of Pro Watercross, and/or who subsequently is shown to have alcohol in their system, as tested by any recognized test method at Pro Watercross’ sole discretion, shall be deemed in violation of this Code. Further, while it is not a violation of this Code for any participant or Pro Watercross Member to consume alcoholic beverages, in accordance with law and regulations, at an event site, it is a violation for any member to act in an unsafe manner anywhere at an Pro Watercross Event as a result of any impairment. It is a violation of this Code to supply alcoholic beverages at an Event site in violation of law or regulations, or in a manner to cause a violation of this Code.
Pro Watercross may require participants/ Pro Watercross Members to participate in systematic testing for drugs and/or alcohol. Pro Watercross may require any participant or Pro Watercross Member, to undergo testing for Illegal Substances, or use of Controlled Substances, prescription or over-the counter medication or alcohol, in violation of this Code. Such testing may be done for suspicion of violation of this Code, either through reports from a reasonable source, or by observation of signs, symptoms or behaviors or may be done randomly. Further, testing may be done after any incident on or off track. Testing may be required either at an Event or away from an Event.
Refusal to promptly authorize and submit to such testing is a violation of this Code. Refusal to permit release of the results of any tests by any testing facility or person conducting such test, to Pro Watercross, is a violation of this Code. Any testing done “for cause” or “reasonable suspicion” shall be done at the participant or Pro Watercross Member’s expense. Testing shall be done at a facility of Pro Watercross’ choosing. The results of such testing are not subject to protest or appeal. Pro Watercross may publish the results of such testing at its discretion. A person or entity referred to in such notice shall have no right to act against Pro Watercross or the person publishing the notice. Where testing is not available, but where Pro Watercross suspects impairment, for any reason, Pro Watercross may remove the participant or Pro Watercross Member from the facility, or take such other action as may be deemed appropriate.
Any participant or Pro Watercross member who is found in violation of any part of this section may be required to undergo testing or re-testing prior to any further participation in any Pro Watercross sanctioned event or reinstatement of any Pro Watercross membership or privileges. Pro Watercross does not provide rehabilitation services. Nor does this Code provide for periods of rehabilitation, with respect to this section of the Code. However, nothing contained herein is intended to dissuade anyone from seeking treatment or help for drug or alcohol problems, and Pro Watercross strongly encourages participants or members in need to seek such treatment or help.
PHOTO POLICY
PHOTO POLICY:
Due to the volume of unlawful video, photo and trademark reproductions taking place with respect to participants, events and trade names recently, it has become necessary for Pro Watercross to strictly enforce certain rules and guidelines with respect to the usage and sale and digital distribution of such media. While we certainly understand that this can be upsetting to the casual weekend photographer, it is important to understand the legal ramifications that exist. Pro Watercross does not intend to prohibit the use of still point and shoot cameras at our events; however, the sale of such photos is strictly prohibited without prior written approval from Pro Watercross or any sanctioned Pro Watercross event.
All persons agree that all commercial rights to any and all photographs, video tapes, motion pictures, sound recordings, etc. made of any Pro Watercross event are owned solely by Pro Watercross, regardless of what party created such properties. Any sale of such images or recordings, on or off the Pro Watercross premises, is strictly prohibited except by Pro Watercross, or its officially approved agents. Any such images or recordings created by non-approved agents will be solely for their individual and non-commercial use.
Broadcasts and other rights:
Pro Watercross exclusively and in perpetuity own any and all rights to broadcast, transmit, film, tape, capture, overhear, photograph, collect or record by any means, process, medium or device (including but not limited to television, cable television, radio, pay-per-view, closed circuit television, satellite signal, digital signal, film productions, audiotape productions, transmissions over the Internet, public and private online services authorized by Pro Watercross, sales and other commercial projects, and the like), whether or not currently in existence, all images, sounds and data arising from or during any event, and that Pro Watercross is and shall be the sole owner of any and all intellectual property rights (including, but not limited to, patents, copyrights, trademarks, design rights, and other proprietary rights) worldwide in and to these works and in and to any other works, copyrightable or otherwise created from the images, sounds and data arising from, during or in connection with any event. In addition to the extent not already owned by Pro Watercross, each person hereby assigns to exclusively and in perpetuity any and all rights set forth above.
ACCREDITATION; USE OF IMAGES:
Legitimate Media Assignment Required:
Only accredited photographers on assignment for a Pro Watercross recognized news media outlet or other Pro Watercross accepted media outlets will be permitted to photograph Pro Watercross events. Pro Watercross does not generally recognize photo agencies or freelancers as media. Pro Watercross has the sole discretion to determine who is or is not Pro Watercross-recognized.
No Freelancing:
Freelance photographers are not permitted without specific assignment from a Pro Watercross-recognized media outlet, and as expressly permitted by Pro Watercross. A photo credential is required.
No Commercial Use:
All use and reuse of all images obtained at all Pro Watercross events for commercial purposes is prohibited except in accordance with a written license from Pro Watercross. To inquire about licensing of event photos for commercial purposes, please contact Pro Watercross.
Restricted Photo Area Access:
Accredited photographers may shoot from the shoreline of any event, photographers that would like to gain Restricted Photo Area access to the announcing tower, water tower and in the water must apply for a special access pass a minimum of two weeks prior to the event weekend. Request for special access does not mean that special access will be granted.
Please note: The Restricted Photo Area is a working area, please be courteous to the staff, officials, colleagues and spectators and leave the area when you are not working.
Attire:
You must wear a shirt with fully-covered shoulders and shoes with closed heels and toes (no open toed shoes, sandals, clogs, slides, etc.).
Policy Changes:
This Photo Policy is subject to change and compliance with the Photo Policy as in effect at each event is required.
DRONE POLICY
UNMANNED AERIAL VEHICLES (UAVS)/DRONE POLICY
To ensure the safety and enjoyment of all our guests, Pro Watercross strictly prohibits the operation of or use of any unmanned aerial vehicles (UAVs), commonly known as “Drones,” on, from, or above Pro Watercross premises, events or venues without specific written permission from an official of Pro Watercross. This includes all UAVs regardless of size, weight, or purpose.
