PHOTO POLICY:
Due to the volume of unlawful video, photo and trademark reproductions taking place with respect to participants, events and trade names recently, it has become necessary for Pro Watercross to strictly enforce certain rules and guidelines with respect to the usage and sale and digital distribution of such media. While we certainly understand that this can be upsetting to the casual weekend photographer, it is important to understand the legal ramifications that exist. Pro Watercross does not intend to prohibit the use of still point and shoot cameras at our events; however, the sale of such photos is strictly prohibited without prior written approval from Pro Watercross or any sanctioned Pro Watercross event.
All persons agree that all commercial rights to any and all photographs, video tapes, motion pictures, sound recordings, etc. made of any Pro Watercross event are owned solely by Pro Watercross, regardless of what party created such properties. Any sale of such images or recordings, on or off the Pro Watercross premises, is strictly prohibited except by Pro Watercross, or its officially approved agents. Any such images or recordings created by non-approved agents will be solely for their individual and non-commercial use.
Broadcasts and other rights:
Pro Watercross exclusively and in perpetuity own any and all rights to broadcast, transmit, film, tape, capture, overhear, photograph, collect or record by any means, process, medium or device (including but not limited to television, cable television, radio, pay-per-view, closed circuit television, satellite signal, digital signal, film productions, audiotape productions, transmissions over the Internet, public and private online services authorized by Pro Watercross, sales and other commercial projects, and the like), whether or not currently in existence, all images, sounds and data arising from or during any event, and that Pro Watercross is and shall be the sole owner of any and all intellectual property rights (including, but not limited to, patents, copyrights, trademarks, design rights, and other proprietary rights) worldwide in and to these works and in and to any other works, copyrightable or otherwise created from the images, sounds and data arising from, during or in connection with any event. In addition to the extent not already owned by Pro Watercross, each person hereby assigns to exclusively and in perpetuity any and all rights set forth above.
ACCREDITATION; USE OF IMAGES:
Legitimate Media Assignment Required:
Only accredited photographers on assignment for a Pro Watercross recognized news media outlet or other Pro Watercross accepted media outlets will be permitted to photograph Pro Watercross events. Pro Watercross does not generally recognize photo agencies or freelancers as media. Pro Watercross has the sole discretion to determine who is or is not Pro Watercross-recognized.
No Freelancing:
Freelance photographers are not permitted without specific assignment from a Pro Watercross-recognized media outlet, and as expressly permitted by Pro Watercross. A photo credential is required.
No Commercial Use:
All use and reuse of all images obtained at all Pro Watercross events for commercial purposes is prohibited except in accordance with a written license from Pro Watercross. To inquire about licensing of event photos for commercial purposes, please contact Pro Watercross.
Restricted Photo Area Access:
Accredited photographers may shoot from the shoreline of any event, photographers that would like to gain Restricted Photo Area access to the announcing tower, water tower and in the water must apply for a special access pass a minimum of two weeks prior to the event weekend. Request for special access does not mean that special access will be granted.
Please note: The Restricted Photo Area is a working area, please be courteous to the staff, officials, colleagues and spectators and leave the area when you are not working.
Attire:
You must wear a shirt with fully-covered shoulders and shoes with closed heels and toes (no open toed shoes, sandals, clogs, slides, etc.).
Policy Changes:
This Photo Policy is subject to change and compliance with the Photo Policy as in effect at each event is required.
